Risk Retention Groups (RRGs) offer alternative ways from traditional insurance companies to protect liability. The RRG is owned by its members and all members must be insured by the RRG. This allows the members to pool their risks and form an insurance company that operates through a combination of state and federal guidelines from the Federal Liability Risk Retention Act (LRRA).
Although the regulation of RRGs is comparable to that of traditional insurers, there are some key differences. Few RRGs, if any, are required to submit rate and form filings - rates are typically based on an actuarial analysis of the membership, and one of the advantages is the ability to conform the policy to suit the needs of the membership. In addition, the LRRA specifically precludes RRGs from participating in state guaranty funds.
